Not illustrated. 1905 Excerpt: ...should there be no other objection than is disclosed by the Present appeal. Deposit to be refunded. Subsequently the matter came before the Local Land Board, and the Board allotted the area to Treloar, and the Minister thereupon appealed againt such allotment on the following grounds: --1. That the Local Land Board was in error in dealing with the confirmation or allowance of the said application, pending an appeal from the judgment of the Land Appeal Court to the Supreme Court on questions of law arising in the case and affecting the said confirmation or allowance, 2. That the Local Land Board was in error in confirming or allowing the said application, inasmuch as there was an objection to such confirmation or allowance not disclosed in the appeal, viz' That the land in question was not available for purchase under Volunteer Land Orders, 3. That the land confirmed or allowed was not open to conditional sale within the meaning of section 22 of the Crown Lands Act of 1884, and also submitted a case for submission to the Supreme Court againat the decision of the Land Appeal Court in case 6,839. The following is the decision thereon: --(No. 6,839.) The President: The Land Board, when it dealt with the case on the 25th November last, gave the following decision: -- Whereas on the 24th and 25th-days of November, 1903, it became a matter for investigation before us to consider the application dated 19th August, 1903. by Thomas John Treloar, for Volunteer Land Order Selection 1903-1, Tamworth, 19 acres 2 roods 10 perches, parish of Tamworth, county of Inglis, being measured portions 229, 231-233, 234, and 236; and having taken evidence and inquired into the said matter, we find that this is an application in virtue of a Volunteer Land Order Certificate for a...
