Public Health Act, 1875.--Receiver--Owner.--Where a receiver of the rents and profits of certain property had been appointed in an action: held (by Mr. Justice Chitty), that he was not the "owner" for the purposes of the Public Health Act, 1875, sec. 4.--Corporation of Bacup v. Smith, High Court, Ch. Div., 23 April 1890. Foreign Judgment.--Fraud on a foreign Court--Evidence--Admimbility of--Action in Enylish Court.--An action was brought on a foreign judgment obtained by the plaintiffs against the defendant in the Sicilian Court in respect of certain bills of exchange. The defendant pleaded that the alleged judgments were obtained by fraud, in that the bills of exchange had been fraudulently prepared by the plaintiffs and one R., an agent of the defendant, for the purpose of defrauding the Sicilian Court. He further alleged that the said bills were given for the purpose of enabling R to repay to the plaintiffs money lost by R in speculative and gambling transactions to the plaintiffs; and that the plaintiffs concealed this from the foreign Court, and induced the Court to believe that the bills were discounted in the ordinary course of business with the authority of the defendant.
